These Terms of Service ("Terms") govern your use of BookWithZara's AI booking assistant ("Zara") and related services, including our booking page product (collectively, the "Service"). By using the Service, you agree to these Terms.
BookWithZara provides an AI-powered booking assistant that enables service businesses ("Clients") to handle appointment bookings through Instagram Direct Messages, SMS, and a web-based booking page. End customers ("Users") interact with the Service to book appointments with our Clients.
You must be at least 18 years of age to use the Service as a Client (business owner). There is no age restriction for Users booking appointments, provided you comply with any age requirements of the business you are booking with.
As a Client (business owner) using BookWithZara, you agree to:
Access to the Service requires a paid subscription. Fees are charged monthly in advance. All fees are in Canadian dollars unless otherwise stated. Subscriptions automatically renew unless cancelled before the renewal date. We reserve the right to change pricing with 30 days' written notice.

Clients may cancel their subscription at any time by contacting us at hello@bookwithzara.ca. Cancellation takes effect at the end of the current billing period. Setup fees are non-refundable. Monthly subscription fees are non-refundable once charged.
Zara's responses are generated by artificial intelligence and are provided for informational and convenience purposes. BookWithZara does not guarantee the accuracy, completeness, or appropriateness of any AI-generated response. Clients are responsible for ensuring Zara is configured with accurate information about their business. BookWithZara is not liable for any booking errors, miscommunications, or losses arising from AI-generated responses.
The Service integrates with third-party platforms including Meta (Instagram), Google (Calendar and AI), Resend (email), and Twilio (SMS). Your use of these integrations is subject to the respective third parties' terms of service and privacy policies. BookWithZara is not responsible for the availability, accuracy, or actions of these third-party services.
You agree not to use the Service to:
BookWithZara and its licensors own all intellectual property rights in the Service, including software, design, and content. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein. You retain ownership of your business data and content you provide to us.
To the maximum extent permitted by applicable law, BookWithZara shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claim arising under these Terms shall not exceed the fees paid by you in the three months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
You agree to indemnify and hold harmless BookWithZara and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if continued service would expose us or third parties to legal liability or harm.
These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Winnipeg, Manitoba.
We may update these Terms from time to time. We will post the updated Terms at this URL with a revised effective date. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
